Terms of Service

Please read these Terms carefully. They explain your rights and responsibilities when using SmartKid.
1. Agreement to these Terms
These Terms of Service describe the rules for using SmartKid, also referred to as Smart Kid, our website, learning content, parent dashboard, child learning experience, subscriptions, and related services.
By creating an account, starting a subscription, or allowing a child to use SmartKid, you agree to these Terms. If you use SmartKid on behalf of a child, you confirm that you are the child’s parent or legal guardian, or that you have authority to supervise the child’s use of the service.
2. The SmartKid service
SmartKid provides interactive educational content for children, including lessons, exercises, progress tracking, rewards, and parent-facing learning tools. Our content is designed to support learning, but it is not a substitute for professional educational, medical, psychological, or developmental advice.
We may update, improve, remove, or change content and features over time to keep the service useful, safe, and reliable.
3. Parent and guardian responsibility
SmartKid is intended for children to use with parent or guardian involvement. Parents and guardians are responsible for setting up accounts, managing child profiles, supervising use, reviewing learning activity, and deciding whether the service is appropriate for each child.
You are responsible for keeping your login information secure and for activity that occurs through your account.
4. Subscriptions, billing, and renewals
Some SmartKid features require a paid subscription. Subscription prices, billing periods, and included features are shown before purchase. Paid subscriptions automatically renew unless canceled before the next renewal date.
Payments are processed through Polar, our payment provider and Merchant of Record, and/or Polar’s payment partners. By purchasing a subscription, you authorize Polar to charge the selected payment method for applicable subscription fees, taxes, and other required amounts.
5. Cancellation policy
You may cancel your subscription at any time. After cancellation, you will continue to have access to paid SmartKid features until the end of your current paid billing period. Your subscription will not renew, and no further subscription charges will be made unless you resubscribe.
Canceling a subscription does not automatically create a refund. Refund requests are handled under our Refund Policy.
6. Refunds
Our refund rules are described in our Refund Policy. In general, you may request a refund within 14 days of an initial purchase or renewal by contacting support@smartkid.com.
Polar may also issue refunds on our behalf when required by law, payment network rules, fraud prevention, chargeback prevention, or Polar’s own policies.
7. Acceptable use
You agree not to misuse SmartKid, attempt to access accounts or systems without permission, interfere with service security, copy or resell our content, upload harmful material, or use the service in a way that violates applicable laws or the rights of others.
We may suspend or terminate access if we believe an account is being used in a harmful, fraudulent, unlawful, or abusive manner.
8. Intellectual property
SmartKid and its lessons, exercises, designs, software, text, graphics, logos, and other materials are owned by SmartKid or our licensors and are protected by intellectual property laws.
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable license to use SmartKid for personal, family, and educational purposes. You may not copy, distribute, reverse engineer, sell, or commercially exploit the service without our written permission.
9. Service availability and changes
We work to keep SmartKid available and reliable, but we do not guarantee uninterrupted or error-free operation. Maintenance, updates, outages, third-party issues, or events outside our control may affect availability.
We may change or discontinue parts of the service at any time, including to improve safety, comply with law, or update our learning experience.
10. Disclaimers and limitation of liability
SmartKid is provided on an “as is” and “as available” basis. To the fullest extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose, and non-infringement.
To the fullest extent permitted by law, SmartKid will not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of data, profits, or business opportunities. Our total liability for any claim related to the service will not exceed the amount you paid to SmartKid for the service during the three months before the claim arose.
11. Changes to these Terms
We may update these Terms from time to time. When we make material changes, we will update the “Last updated” date and may provide additional notice where appropriate. Continued use of SmartKid after changes become effective means you accept the updated Terms.
